End User License Agreement
By downloading and/or installing Koval Font Software you agree to the following terms:
1. Contracting Parties
1.1. This Koval Font Software License Agreement (Agreement) is concluded between Aliaksei Koval, further named in this Agreement as Author and the end user of Koval Font Software, further named in this Agreement as User. By downloading and/or installing Koval Font Software User undertakes to comply with the provisions set forth below.
1.2. If User disagrees in part or in full with the conditions hereof, he shall not download, install or use the Koval Font Software in question and must return it to Author and/or remove the Koval Font Software and all its copies.
1.3. If User is entering this Agreement on behalf of his or her employer, the terms and conditions recited herein apply to User’s employer as well as to User as a representative of your employer. Should the User cease working for his or her employer, User will no longer be entitled to use the Koval Font Software, but User’s employer will continue to be the license holder.
2. Output Device Limitations
2.1. For the aims of this Agreement Output Device is any piece of computer hardware equipment used to communicate the results of data processing carried out by an information processing system (such as a computer) to the outside world in human-understandable visual and/or hardware presentation.
2.2. Installation on Server computers (devices designed to run an application program that accepts connections in order to service requests by sending back responses and (or) perform services for connected clients as part of a client-server architecture) is not allowed.
2.3. The Koval Font Software is licensed for use with a maximum of five (5) Output Devices. For example: four (4) one-monitor workstations and one (1) printer; one (1) two-monitor workstation, one (1) printer, one (1) portable computer and one (1) PDA.
3. Software Usage Limitations
3.1. User is permitted to use the Koval Font Software to create any object, document electronic or hardware containing graphic results of the Koval Font Software operation (further – the Koval Fonts) including logotypes.
3.2. User is permitted to make a single back-up copy. Except as permitted herein, User may not modify, adapt, translate, reverse engineer, decompile, disassemble, alter or otherwise copy the Koval Font Software.
3.3. Koval Font Software may not be sublicensed, sold, leased, rented, lent, or given away to another person or entity. User may not place the Koval Font Software on-line in a downloadable format.
3.4. User may not embed or include the Koval Font Software or it’s part in documents and/or software except embedding glyph subsets in .pdf-files.
4. Derivative Works
4.1. All rights for derivative works made with Koval Font Software and under the terms of Koval Font Software License Agreement are belong to person or organization made the derivative work.
4.2. The Koval Font Software is protected under domestic and international trademark and copyright law. The User agrees to identify the Koval Fonts by name and credit Author’s ownership of the trademarks and copyrights in any design or production credits. For example: Font name-of-the-Koval-Font by Koval type foundry; font name-of-the-Koval-Font © Koval Type Foundry, 2008.
5. Author’s Warranties
5.1. The Author warranties the Koval Font Software functioning according to Koval Font Software specifications.
5.2. AUTHOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE. WITHOUT LIMITING THE FOREGOING, AUTHOR SHALL IN NO EVENT BE LIABLE TO THE LICENSED USER OR ANY OTHER THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT EVEN IF NOTIFIED IN ADVANCE. UNDER NO CIRCUMSTANCES SHALL AUTHOR'S LIABILITY EXCEED THE REPLACEMENT COST OF THE SOFTWARE.
6. Termination Of The Agreement
6.1. This Agreement is concluded sine die – unless any party of this Agreement manifests it’s will to terminate Koval Font Software License Agreement.
6.2. Author can terminate this Agreement unilaterally the moment any violations of this Agreement and/or related laws are revealed.
6.3. Upon termination of this Agreement User is to remove the Koval Font Software and all its copies.
